What Is CLRA and Who It Applies To
The Contract Labour (Regulation and Abolition) Act, 1970 governs the employment of contract labour in establishments. Its primary purpose is to regulate the conditions of service of contract workers and prevent exploitation.
CLRA applies to any principal employer who engages 20 or more contract workers (through one or more contractors) on any day of the preceding 12 months. Any contractor who employs 20 or more contract workers in any establishment also needs a separate licence.
The 20-worker threshold counts all contract workers on site — even if they work for different contractors on different projects. Once covered, the Act continues to apply even if the count later falls below 20.
The 11 Documents Labour Inspector Checks First
- 1Registration Certificate (Form I) — Principal Employer's registration under CLRA. Must be valid and displayed at workplace.
- 2Contractor's Licence (Form IV/V) — Separate licence for each contractor working on site. Check expiry dates.
- 3Muster Roll (Form XVI) — Daily attendance of every contract worker. Must show name, designation, and attendance for each day.
- 4Wage Register (Form XVII) — Monthly wages paid to each contract worker. Must include basic, DA, deductions, and net payable.

- 11Annual Return (Form XXIV) — Filed annually by 15th February with the licensing officer. Must cover all contract workers employed during the year.
The 4 Registers Most Commonly Found Deficient in WB
- Form-XIII (Register of Contract Labour): Most principal employers either maintain this in an incorrect format or fail to update it when new contractors are engaged. Every change of contractor must be reflected immediately.
- Wage Register: The prescribed wage register under CLRA requires wages to be shown in specific columns — basic, DA, allowances, EPF deduction, ESIC deduction, advance deduction, and net paid. Generic payroll printouts are routinely rejected.
- Muster Roll Gaps: Gaps in daily attendance are treated as evidence of off-book employment. Any absence must be recorded as "Absent" not left blank.
- Overtime Register: Absent in most establishments. Required separately from the attendance register showing hours, rate, and overtime wages paid.
Principal Employer's Liability
Under Section 20 of CLRA, if the contractor fails to pay wages or provide statutory amenities (rest rooms, canteen, drinking water, first aid), the principal employer is jointly and severally liable to ensure these are provided. The principal employer may recover such costs from the contractor, but cannot use the contractor's default as a defence against the Labour Inspector.

Surprise inspections have increased significantly — 3 major factory units in Hooghly were fined in Q4 FY 2024–25 for CLRA violations including missing contractor licences, incorrect wage registers, and absent Form-XIII. The fines ranged from ₹50,000 to ₹2 lakh per unit. Principal employers were held jointly liable for contractor defaults.
